Condominium Order: Settlement of Rights (Registration/ Amendment)
A house or plot with two apartments or more can, in certain cases, be registered in the Book of Condominiums as a condominium.
In Israel, registration as a cooperative house (condominium) holds advantages that often have direct and even immediate implications on the value of the land and real estate. Therefore, compared to other possibilities for land registration in Israel, registration as a condominium is often a preferred solution for the various titleholders.
Infonir has vast knowledge and experience in the full execution of registering and/or amending a condominium order, and in negotiating with tenant representatives and the various commissioner bureaus. Infonir acts in accordance with the requirements of the Land Law, 5729-1969 and the Land Regulations (Management and Registration) 5772-2011, until the issuing of a registration order by the Commissioner of Registration of Cooperative Houses (Condominiums).
Registration/ Amendment of Condominium Orders
The process of registering a condominium begins with analyzing the state of land registration, mapping the rights to the land, and analyzing the nature of the legal rights (proprietary, contractual, etc.). Afterwards, depending on the results of the first step, the application documents (scenario, regulation, order, application, etc) are drafted by the authorized parties, and submitted for the review and approval of the managing attorney. Following the attorney’s approval, the application is submitted to the rights owners for signing, and then submitted for registration with the Commissioner of Registration of Cooperative Houses (Condominiums). Finally, the condominium order is registered.
The process can be complex and usually lasts at least 6 months.
Managing the Registry of Rights
In many cases, a housing company, contracting company, or entrepreneur manages the rights to a multi-unit building before a condominium order is given. This stage may last months and even years, and therefore it is extremely important to have professional and accurate management of the registration of rights in the condominium prior to registration. Proper management of the registration of rights enables the purchasers to act as owners of their properties, to conduct proprietary transactions, to register collaterals in favor of loaning banks, and eventually to register part of the house as a condominium in the Registry of Cooperative Houses (Condominiums).
